COALITION AGAINST TORTURE
Petition
to the Government of Canada
Recognizing that Canada is a signatory to the Convention against
Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment,
G.A. res. 39/46, [annex, 39 U.N. GAOR Supp. (No. 51) at 197, U.N.
Doc. A/39/51 (1984)], entered into force June 26, 1987; and
Whereas Article 14 of the said Convention requires that:
Each State Party shall ensure in its legal system that the victim
of an act of torture obtains redress and has an enforceable right
to fair and adequate compensation, including the means for as
full rehabilitation as possible.
We the undersigned, members of the International Coalition Against
Torture, call upon the Government of Canada to:
Give immediate and serious consideration, and to undertake all
necessary and immediate steps at the next session of parliament,
to amending the State Immunity Act, R.S.C. 1985, S-18, so as to
provide for an express exception for state violations of peremptory
norms of international law which include, but are not limited
to torture, genocide, apartheid, crimes against humanity and slavery.
